Cabo Verde Airlines has created this Privacy Notice to inform you about the terms under which it collects and processes personal data, in accordance with Law No. 133/V/2001, of January 22, as amended by Law No. 41/VIII/2013, of September 17, which establishes the general legal framework for the protection of personal data of individuals—henceforth referred to as the Law—and other applicable legislation on personal data protection. The personal data processing described in this Notice concerns the personal data of users of our website. 

In this regard, we will explain how your data is processed, how we protect it, and how you can exercise your rights.

Cabo Verde Airlines ensures that the personal data accessed is:

For the purposes specified in this Privacy Notice, the responsible entity collects and processes the personal data mentioned in each type of processing, which will depend on the different services you request or the contractual relationship you maintain with our organization. 

Cabo Verde Airlines is committed to treating your information with total confidentiality and applying appropriate physical, technical, and organizational security measures to protect your personal data. 

It guarantees and is responsible, in any case, for the truthfulness, accuracy, validity, and authenticity of the personal data provided and commits to keeping it duly updated. 

What is the source of your personal data and what data do we process? 

Sources from which personal data comes 

Data provided directly by you: Cabo Verde Airlines collects and processes, directly through the website, the personal data necessary to market the services present on the website, manage established contractual relationships, send newsletters and marketing actions, and disclose promotions, contests, and prizes. 

Data provided indirectly about you: from our suppliers who provide services on our behalf; from our partners; from travel agents or other operators who book a flight for you. Additionally, through your browsing, different cookies may be installed in accordance with our Cookie Notice. Only technical cookies or those strictly necessary for the site's operation will be installed (other cookies will only be installed with your prior and explicit consent through the corresponding cookie configuration panel). 

Types of Personal Data 

Cabo Verde Airlines collects and processes your personal data when you use our services, whether directly or through partners, travel agents, or providers acting on our behalf. 

The categories of data include, but are not limited to: 

  • Flight reservations and purchases: name, date of birth, gender, marital status, contact details, identification details (passport or other document), payment data, nationality. 
  • Travel management: information about luggage, emergency contacts, visas, vaccination certificates, and any special assistance or dietary needs. 
  • Interactions: communications with our organization (phone, email, social media), participation in satisfaction surveys, or use of our platforms (cookies and tracking technologies). 
  • Additional purchases: extra services related to travel and in-flight sales. 
  • Browsing and online behavior: IP address and behavioral habits on our website (e.g., how you navigate through different sections of the website) if you have accepted the use of cookies and other similar technologies; ISP data (the domain of the provider that provides access to the network) and the date-time associated with access. 

We may also process Special Categories of Data, which include health information, religious beliefs, or data revealing your origin, only when: 

  • You give us explicit consent; 
  • It is required by legal obligations; 
  • It is necessary to provide assistance during your trip. 

We inform you that not all categories of data indicated above are used for all treatments described in this Privacy Notice. The next section (“What are the purposes preceding the collection of your personal data and what is the legality basis for its processing?”) describes the different data processing performed by Cabo Verde Airlines, indicating their purposes and corresponding legal bases for legitimacy and detailing which specific data categories are used. 

Furthermore, we inform you in the next section that when a category of personal data is associated with a specific processing, it does not imply that all data within that category will always be used when the referred processing is conducted. As per the legal principle of data minimization, these personal data will only be used to the extent that they are appropriate and relevant for fulfilling the purpose assigned in this Privacy Notice and the corresponding processing. 

What are the purposes preceding the collection of your personal data and what is the legality basis for its processing? 

Cabo Verde Airlines uses your personal data for the management and execution of a potential contractual relationship, for compliance with legal obligations, as well as to satisfy the legitimate interests of the organization. 

Cabo Verde Airlines also uses your data, with your prior consent, for marketing communications, either through newsletters or other legitimate means. 

More specifically, we use your personal data for the following purposes and according to the following legality bases: 

Execution of Contract or Precontractual Diligence 

Including: 

  • Confirmation or alteration of reservations and ticket issuance; 
  • Sending confirmation and/or change of reservations; 
  • Sending information related to other contracted services and/or products; 
  • Sending payment and billing information; 
  • Sending information related to your flights, including operational updates; 
  • Managing the check-in process, including document verification, boarding, acceptance, and handling of luggage; 
  • Managing situations of operational disruption; 
  • Responding to requests, complaints, suggestions, or communications. 

Legitimate Interests of Cabo Verde Airlines 

Including: 

  • Sending relevant information about your trip; 
  • Evaluating the service provided to you following a flight; 
  • For auditing purposes; 
  • Ensuring the safety of your flight; 
  • For marketing communications, unless you have opposed the use of your data. 

It is also in the legitimate interest of Cabo Verde Airlines to ensure security within the entity’s premises. The data processing operations we may carry out in this context include: 

Utilizing images captured by surveillance cameras installed within Cabo Verde Airlines’ premises for the purposes of (i) managing access to our facilities; and (ii) preserving the security of individuals, property, and premises against theft and intrusion, as well as any type of vandalism or criminal action that may compromise the safety of such individuals, property, and facilities. 

Surveillance recordings for private security purposes will be deleted thirty days from the date of recording, unless otherwise determined by judicial authorities or competent Security Forces. 

The existence of surveillance systems is properly informed through indicative signage. 

Explicit Consent of the Data Subject 

Including, but not limited to: 

  • For sending newsletters with regular offers from Cabo Verde Airlines and/or partners; 
  • To receive specific information and offers from Cabo Verde Airlines and/or partners; 
  • For market studies and customer surveys; 
  • For personalized use of the website and personalized offers, including profile definition; 
  • To support processes related to the use of the website, with reminders and live chats; 
  • For analytical purposes, to optimize our offerings for you; 
  • Event management and consequent image collection. 

Any consent given can be withdrawn at any time. Withdrawal of consent only applies to future processing and does not affect the lawfulness of the data processed prior to such withdrawal. 

Compliance with Legal Obligations 

Including, but not limited to: 

  • For the prevention, investigation, and repression of criminal offenses, such as fraud, including credit card or identity fraud, and fraudulent means to obtain special terms or rates;

  • For customs and immigration control; 
  • To address public health issues. 

Cabo Verde Airlines may collect and process personal data to comply with national and/or international legislation on immigration, territorial security, and the prevention, detection, investigation, and repression of terrorism and serious and organized crime, in accordance with the legal norms applicable to each journey, as well as to meet requirements established by health authorities in matters of public health. 

Protection of Vital Interests of the Data Subject 

Cabo Verde Airlines may also collect personal data if the processing is necessary to protect the vital interests of the data subject, in cases where the data subject is physically or legally incapacitated to give their consent (e.g., due to incapacity resulting from a health issue during a flight). 

We remind you that some of this data is essential for ticket issuance and fulfillment of legal requirements. If not provided, we may not be able to provide the requested service. 

Recording of Telephone Calls 

Due to your telephone contact and in the context of Cabo Verde Airlines' activity, we may record calls, with prior information provided and based on your consent, for managing the pre-contractual and contractual relationship, as well as for improving our provided services and quality control. 

These call recordings will be kept for the period indicated in the decisions of the CNPD regulating this processing activity, namely Decision No. 1039/2017. 

For how long do we keep your personal data? 

The personal data collected and processed are retained according to their purpose, respecting the applicable legal deadlines. 

In cases where a legal deadline does not apply to the retention and storage of personal data, such data will only be stored and preserved for the appropriate period and to the necessary extent, given the purposes for which they were collected, except if, at any time, the data subject, within legal limits, exercises their rights of opposition, limitation, deletion, or withdrawal of consent. 

To whom do we communicate your personal data? 

Your personal data may be communicated to third parties in the following situations: 

Service Provision: Cabo Verde Airlines may use external entities (e.g., handling services, information technologies, marketing, consulting, or auditing). These entities act on our behalf, under our instructions, and are obligated to ensure adequate technical and organizational measures for the protection of your data. 

Sharing within the scope of travel: When your itinerary includes flights operated by other airlines, or when necessary for the provision of complementary services (e.g., rent-a-car, hotels, or other partners contracted by you). 

Compliance with Legal Obligations: We may transmit data to airports, customs authorities, immigration authorities, police, government, or regulatory authorities whenever required by law or necessary for your travel. 

Protection of Legitimate Interests: Your data may also be shared with financial institutions, credit/debit card companies, fraud prevention service providers, insurance companies, lawyers, or courts, within the scope of legal, administrative, or extrajudicial processes. 

In all these situations, Cabo Verde Airlines commits to adopting appropriate measures to ensure the protection and confidentiality of your personal data. 

Why do we share your personal data? 

Cabo Verde Airlines may share your personal data with third entities that need access to it. These entities may include suppliers, partners, and service providers who work with us in providing our services. 

In the course of its activities, Cabo Verde Airlines may engage subcontractors that will process your personal data exclusively based on our instructions. Cabo Verde Airlines ensures that such subcontractors provide adequate guarantees concerning the implementation of technical and organizational measures that comply with the applicable legislation and protect the rights of the data subjects.

Under what circumstances do we transfer your personal data to third countries? 

The activities conducted by Cabo Verde Airlines may involve transferring your personal data to third countries, even if this happens occasionally and always in connection with other services used by the organization. In such situations, all necessary and appropriate measures will be taken to ensure the protection of your personal data. 

One such situation occurs within Cabo Verde Airlines’ presence on social networks, with limited influence over the data processing carried out by the operators of these networks (e.g., management of members and general information management). In situations where we have no influence, we strive to ensure, as far as possible, that the social network operators act in compliance with the privacy and data protection requirements established by the Legal Framework on Data Protection. However, in many cases, we have no influence over this data processing and do not have clear knowledge of the data being processed on certain occasions. 

The operators of social networks manage all the IT infrastructure of the service, applying their own privacy and data protection rules and, furthermore, maintain their own relationships with users (as far as they are registered users of the social network). Additionally, the operators are fully responsible for all matters related to the data of user profiles, to which Cabo Verde Airlines does not have access.

  • Right to Limit Processing: You have the right to request that we limit the processing of your personal data, which means that we can continue to store it, but we will not continue to process it if any of the following conditions are met: for example, when you contest the accuracy of the data, for a period allowing the controller to verify its accuracy; the processing is unlawful, and you oppose the deletion of the data and instead request the limitation of its use; our entity no longer needs the data for processing, but you need it to formulate, exercise, or defend claims; you oppose the processing while it is verified whether the legitimate grounds of our entity override your own. 
  • Right to Data Portability: You have the right to have your data transmitted to another data controller in a structured, commonly used, and machine-readable format. This right applies when the processing of your personal data is based on consent or the execution of a contract and is carried out by automated means.
