Within the scope of these conditions, unless otherwise specified in this document, the following terms are used with the meaning indicated:

International Agreements (IIA and MIA) of the International Air Transport Association (IATA) refer to agreements concluded between Air Carriers regarding their liability, applicable to member carriers operating international flights. Under the current legal framework, the airline’s liability is mainly governed by the Montreal Convention of 1999, with the aforementioned agreements considered complementary.

TRANSPORTES AÉREOS DE CABO VERDE, SA has its headquarters in Praia, at Avenida Amilcar Cabral, No. 4, with share capital of 1,000,000,000 CVE, registered at the Commercial Registry Office of the First Class region of Praia under number 10, holder of Tax Identification Number 200121103.

AAC: Civil Aviation Agency, the regulatory authority of the civil aviation sector in Cabo Verde.

Authorized Agent means any individual or entity authorized by the Carrier to represent it in the sale of Air Transport tickets for its services or the services provided by another Carrier, if authorized for this purpose.

Pet refers to a pet (dog or cat) accompanying, in the cabin or hold, the passenger who owns it or an individual assuming responsibility on behalf of the owner during the journey.

Beneficiary is the person who can claim or receive compensation.

Baggage means the belongings and other personal items accompanying the Passenger during the journey. Unless otherwise specified, this term includes both

Checked Baggage and Unchecked Baggage.

Checked Baggage means baggage that is placed under the Carrier’s custody and for which an Identification Form has been issued.

Unchecked Baggage or Hand Baggage means any baggage except Checked Baggage. This baggage remains the responsibility of the Passenger.

Ticket means a valid document establishing the right to transportation, in the form of an "individual or group transport ticket" or equivalent electronic form, issued or authorized by the Carrier or its Authorized Agent. It proves the Transport Contract and includes these General Conditions of Carriage.

Supplementary Ticket means a ticket issued due to a large number of coupons related to a main ticket, forming a single Transport Contract.

Electronic Ticket means a ticket stored by the Carrier or, at the Passenger’s request, by a computerized reservation system and evidenced by the Travel Receipt/Itinerary, electronic flight coupon, or any other document of equal value issued by the Carrier or Authorized Agent.

Carrier Identification Code means the code assigned by IATA identifying each member Carrier, consisting of two or more alphanumeric characters, appearing on the Ticket associated with the flight number.

Travel Receipt or Itinerary/Receipt means one or more documents issued by the Carrier to confirm the issuance of an Electronic Ticket, including the passenger’s surname, flight information, and passenger notices.

Special Conditions means the Carrier’s Special Conditions.

General Conditions of Carriage means these General Conditions of Carriage.

Transport Contract means the statements and provisions contained in the Ticket, identified as such, including these General Conditions of Carriage and passenger notices. For certain territories, specific rules may apply as described in the Special Conditions, accessible from the Carrier’s website for that market.

Convention refers, as appropriate, to:

  • The Convention for the Unification of Certain Rules for International Air Transport, signed in Montreal on 28 May 1999 (“Montreal Convention”);
  • The Convention for the Unification of Certain Rules for International Air Transport, signed in Warsaw on 12 October 1929 (“Warsaw Convention”);
  • Warsaw Convention as amended by Additional Protocol No. 1 of Montreal (1975);
  • Warsaw Convention as amended in The Hague and by Additional Protocol No. 2 of Montreal (1975);
  • Warsaw Convention as amended in The Hague, 28 September 1955;
  • Warsaw Convention as amended in The Hague and by Additional Protocol No. 4 of Montreal (1975);
  • Guadalajara Supplementary Convention (1961, Guadalajara), supplement to the 1929 Warsaw Convention;
  • Tokyo Convention of 1963 (regarding offenses and certain acts committed on board aircraft).
  • Law, Decree-Law (DL), Regulation, and Resolution: any of the following instruments where applicable:
  • Resolution No. 103/VI/2004 of 21 June approving the Montreal Convention of 1999;
  • Decree-Law No. 1/2001 of 20 August, amended by Decree-Law No. 4/2009 of 7 September regulating civil aviation in Cabo Verde;
  • Law No. 66/VIII/2014 of 17 July on entry, stay, exit, and expulsion of foreigners in Cabo Verde, amended by Law No. 80/VIII/2015 of 9 January;
  • Decree-Law No. 35/06 of 26 June 2006 establishing passenger rights in case of denied boarding, cancellation, or delay, including sanctions;
  • Decree-Law No. 27/2015 and amendments regarding persons with reduced mobility;
  • Decree-Law No. 52/2006 on offenses on board civil aircraft;
  • Decree-Law No. 19/2008 on the availability of the complaints book;
  • Relevant EU and US regulations (Regulation (EC) 261/2004, DOT rules);
  • Brazilian ANAC regulations where applicable.
  • The applicable regulations in Brazil, namely the rules of the National Civil Aviation Agency (ANAC);
  • The applicable regulations in the United States, including the provisions of the Department of Transportation (DOT), where applicable.
  • IATA Standardization – Res. 600b (application of 22 SDR/kg, adjusted for inflation, for cargo coverage in commercial operations).
  • Coupon means a flight coupon in paper form or an electronic coupon (stored in a digital medium in the Carrier’s computerized reservation system) containing the name of the Passenger who will travel on the identified flight.
  • Electronic Coupon means a flight coupon in paper form or an electronic coupon (stored in a digital medium in the Carrier’s computerized reservation system) containing the name of the Passenger who will travel on the identified flight.
  • Passenger Coupon or Passenger Receipt means the part of the Ticket, issued by the Carrier or on its behalf, that is identified as such and that the Passenger must retain.
  • Flight Coupon means the part of the Ticket identified as “valid for carriage” or, in the case of an Electronic Ticket, the electronic coupon indicating the specific points between which the Passenger must be transported.
  • Damage includes loss resulting from the death or bodily injury a Passenger may suffer or resulting from delay, total or partial loss, or any other loss arising from or directly related to Air Transport, as defined below.
  • Days mean calendar days, covering all seven days of the week; in the case of sending a notice, the day of sending is not included. For determining the validity of a Ticket, the issue date or flight departure date is not counted.
  • Special Drawing Right (SDR) is an accounting unit of the International Monetary Fund (IMF), whose value is periodically determined by the IMF based on the exchange rates of reference currencies.
  • Voluntary Stopover (or Stop-over) means a stop scheduled by the Passenger during the journey, located between the place of departure and the place of destination, as indicated in the Ticket or Schedule.
  • Intermediate Stops mean points, other than the departure and destination locations, listed on the Ticket or mentioned in the Schedules as planned stops in the Passenger’s itinerary.
  • Baggage Tag means the part of the Identification Form affixed to Checked Baggage.
  • Force Majeure means extraordinary and unforeseen circumstances beyond the control of the party invoking it, which could not have been avoided despite due care.
  • Identification Form means a tag issued by the Carrier exclusively to identify Checked Baggage, including one part affixed to the Baggage (“Baggage Tag”) and another part issued to the Passenger to identify the Baggage (“Baggage Receipt”).
  • Baggage Allowance means the maximum quantity of Baggage (in number, weight, and/or dimensions) determined by the Carrier that each Passenger may carry.
  • Charter means the operation in which the Carrier, after entering into a Transport Contract with the Passenger (“Contracting Carrier”), delegates another carrier (“Operating Carrier”) the responsibility for performing, in whole or in part, the Air Transport. It also means the operation by which any other entity that has a contract with the Passenger (e.g., a tour operator) contracts a Carrier to perform, in whole or in part, the Air Transport.
  • Check-in Deadline means the latest time by which the Passenger must have completed check-in formalities, received a boarding pass or boarding access, and, if applicable, checked their Baggage.
  • Schedules or Schedule Indicators mean the list of departure and arrival times of flights as published in the Carrier’s timetable guides or under its authority, and communicated to the public by electronic means.
  • IATA or International Air Transport Association means the International Air Transport Association, created in April 1945 in Montreal, aiming to promote safe, regular, and economical air transport, facilitate air commerce, and study related issues.
  • Taxes mean charges, levies, and fees imposed by governments, airport operators, or other authorities, as defined in Article 4.
  • Passenger means any person holding a Ticket, except crew members, transported or to be transported by airplane.
  • Passenger in Transit means passengers landing at a location between the departure and final destination who board a connecting flight under the same flight number, including cases where the aircraft changes but the flight number remains the same.
  • Passenger in Transfer means passengers who, at an airport, move directly from one flight to another with different flight numbers.
  • Passenger with Reduced Mobility means any person whose mobility is reduced, whether permanently or temporarily, due to physical (sensory or locomotor), intellectual, or age-related disability, or any other cause, requiring special attention and adaptation of the service to meet their specific needs.
  • Beneficiary means the Passenger or any person entitled to claim compensation on behalf of the Passenger in accordance with applicable law and these General Conditions of Carriage.
  • Contingency Plan for Prolonged On-Runway Delay means the contingency plan adopted by the Carrier in case of a prolonged aircraft delay on the runway at a U.S. airport, as described by the S. Department of Transportation (DOT).
  • Baggage Receipt means the part of the Identification Form issued to the Passenger for the transport of Checked Baggage.
  • Reservation means any transport request made by a Passenger and recorded by the Carrier or its Authorized Agent.
  • TACV – Cabo Verde Airlines Website means the site caboverdeairlines.com.
  • Fares mean the fares for transport reserved by the Passenger for a specific booking class, routes, flights, and, if applicable, dates.
  • Fare Including Taxes means the Fare without Taxes plus applicable Taxes.
  • Fare Excluding Taxes means the Fare charged to the Passenger without Taxes and Ticket Issuance Fees.
  • Ticket Issuance Fees refer to fees billed, if applicable, to the Passenger by the Carrier or its Accredited Agent in consideration of issuing the Ticket. The amount is set by the issuing entity (Carrier or Accredited Agent).
  • Reissue Fees (cf. “Service Fees”)
  • Refund Fees (cf. “Service Fees”)
  • Service Fees refer to fees billed, if applicable, to the Passenger by the Carrier and/or its Accredited Agent, in particular for reissuing or refunding a Ticket. The Passenger is informed of the applicable Service Fees before finalizing the request. The amounts are available from the Carrier or its Accredited Agent.
  • Carrier means TACV – Cabo Verde Airlines or any other Carrier whose Identification Code appears on the Ticket or a Supplementary Ticket.
  • Operating Carrier or Effective Carrier means the Carrier actually operating the flight.
  • Contracting Carrier or Ticketing Carrier means the Carrier with which the Passenger has entered into a Transport Contract and whose Identification Code appears on the Ticket.
  • TACV – National Airline means the national airline of Cabo Verde, licensed to operate in compliance with international regulations.
  • Community Air Carrier means airlines licensed in the European Union, operating under EU law.
  • Air Transport or Air Travel means the carriage of a Passenger and their Baggage by aircraft under the Convention.
  • Codeshare Flight means a flight operated by a Carrier that may be the Contracting Carrier or any other Operating Carrier to which the Contracting Carrier has associated its Identification Code.
  • International Flight means, under the Convention, any flight whose departure and destination locations, and possibly stopovers, are located in the territory of at least two States party to the Convention, notwithstanding intermediate stops or aircraft changes, or within a single State if the intermediate stop occurs in another State, regardless of its Convention status.
  • Domestic Flight means any flight where the departure and destination locations are within the same State, within its territorial continuity.

2.1. General Provisions


(a) The Conditions of the Transport Contract are the conditions referred to in the Passenger’s Ticket. Subject to the provisions of Section 2.2 below, these General Conditions of Carriage apply to any flight or part of flights for which a TACV – CABO VERDE AIRLINES flight number (Identification Code “VR”) is indicated on the Ticket or corresponding Coupon.


(b) These General Conditions of Carriage also apply to free or reduced-fare transport, unless otherwise provided in the Transport Contract or any other contractual document binding TACV – Cabo Verde Airlines to the Passenger.


(c) All transport is subject to the General Conditions of Carriage and the Carrier’s fare rules in effect at the time of the Passenger’s Reservation.


(d) These General Conditions of Carriage have been drafted in accordance with the provisions of the Montreal Convention of 28 May 1999 and with applicable EU legislation.


(e) These General Conditions of Carriage are available from TACV – CABO VERDE AIRLINES or its Authorized Agents and can be consulted on the TACV – CABO VERDE AIRLINES website.

 

2.2. Charter and Codeshare


(a) Certain Carrier flights may be subject to a Charter Contract or Codeshare Agreement.


(b) If transport is operated under a Charter or Codeshare Agreement, these General Conditions of Carriage apply, especially if they are more favorable than those of the Operating Carrier.


(c) The Passenger is informed of the identity of the Operating Carrier(s) at the time the Transport Contract is concluded. After the conclusion of the Transport Contract, another Carrier, excluding the one indicated on the Ticket, may operate the Air Transport in question. The Carrier will inform the Passenger of the identity of the Carrier as soon as it becomes known. In all cases, the Passenger will be informed at the latest during check-in or, in the case of a connection without prior check-in, before boarding in accordance with applicable regulations.

 

2.3. Contingency Plan for Prolonged On-Runway Delay in the United StatesThe contingency plan applicable in the territory of the United States is that of the Carrier actually operating the flight (Operating Carrier).

2.4. Governing LawThese General Conditions of Carriage apply as long as they do not conflict with applicable laws or public policy, in which case such laws or rules shall prevail. Any invalidity of one or more provisions of these General Conditions of Carriage shall not affect the validity of the remaining provisions, unless it is impossible to maintain the Transport Contract without the provision declared invalid or ineffective and which is determinant or essential for the existence of the Contract.

3.1. General Provisions


(a) Subject to proof to the contrary, the Ticket evidences the existence, conclusion, and content of a Transport Contract between the Carrier and the Passenger named on the ticket.


(b) Transport service is provided only to the Passenger(s) whose name(s) appear(s) on the Ticket. The Carrier reserves the right to verify the identification documents of these Passengers. Accordingly, the Passenger must be able to present proof of identity for themselves and any persons under responsibility at any time during their journey.


(c) No Ticket may be transferred, subject to applicable regulations in force, particularly regarding organized travel. If a person other than the Passenger named on the Ticket presents a Ticket for transport or refund, and the Carrier, acting in good faith, transports or refunds that person, the Carrier shall bear no liability toward the said Passenger.


(d) Certain Tickets sold at specific fares may be altered and/or partially or fully refunded. It is the Passenger’s responsibility, when making a Reservation, to consult the conditions applicable to their Ticket and, if necessary, to obtain insurance to cover the risks of cancelling or changing their travel.
(e) Since the Ticket is subject to mandatory formal conditions, it always remains the property of the issuing Carrier.


(f) Except for Electronic Tickets, the Passenger will only be transported if able to present a valid Ticket containing the corresponding Flight Coupon, all other unused Flight Coupons, and the Passenger Coupon. Additionally, any Ticket damaged or altered by someone other than the Carrier or its Authorized Agents shall not be valid for transport. For Electronic Tickets, the Passenger must present identification and will only be transported on a flight if a valid Electronic Ticket has been issued in their name.


(g) In case of lost, partially or fully damaged Tickets, or if a Ticket with the Passenger Coupon and all unused Flight Coupons is not presented, the Carrier shall replace the Ticket, in whole or in part, upon Passenger request. This replacement shall be in the form of a newly issued Ticket, provided the Carrier has proof that a valid Ticket was issued for the relevant flight(s). If proof is not provided, the reissuing Carrier may require the Passenger to pay the Fare Including Taxes for the replacement Ticket. Such payment shall be refunded once the Carrier has proof that the lost or damaged Ticket was not used during its validity period, or if the Passenger finds and presents the original Ticket within the same period.


(h) The Passenger is responsible for taking all necessary measures to ensure that the Ticket is neither lost nor stolen.


(i) If the Passenger benefits from a discount or a Fare subject to special conditions, they must be able, at any time during their journey, to present proof to the Carrier’s partners or representatives justifying the fare applied and its validity. Failure to do so will result in a fare adjustment equal to the difference between the initially paid Fare Including Taxes and the Fare Including Taxes that should have been paid. Otherwise, the Passenger may be denied boarding.

 

3.2. Validity Period

(a) Unless otherwise stated on the Ticket or in these General Conditions of Carriage, and except for Fares that affect Ticket validity, a Ticket is valid for carriage:

  • for one year from the date of issue; or
  • for one year from the date of first Coupon usage, provided this occurs within one year from the date of Ticket issuance.

(b) If a Passenger holding a valid Ticket cannot travel during its validity due to the Carrier being unable to confirm a Reservation for a requested flight at the time of request:

  • the Ticket’s validity will be extended;
  • the Fare Including Taxes will be refunded under the conditions in Article 14, even for non-refundable Tickets;
  • the Passenger will accept the corresponding fare adjustment.

(c) If, after starting their journey, the Passenger is unable to continue traveling for health reasons, the Carrier may extend the Ticket validity until the Passenger is fit to travel again or until the first available flight, upon presentation of a medical certificate indicating the reasons preventing continuation, provided such reasons were unknown at the time of Reservation. Extension applies from the point the journey was interrupted and is valid for the class of the initially paid Fare. If unused Flight Coupons include voluntary stops, the Ticket validity may be extended for up to three months from the date indicated in the medical certificate. The Carrier may, upon request, extend validity for Tickets of direct family members accompanying the Passenger, subject to proof conditions.


(d) If a Passenger dies during their journey, Tickets of accompanying persons may be changed, removing minimum stay requirements or extending validity. In case of death of a direct family member after the journey has started, the Passenger’s and family members’ Tickets may be similarly adjusted. Such changes are valid only upon receipt of a valid death certificate. Extension applies from the interruption point and for the class of the initially paid Fare Including Taxes. No extension shall exceed forty-five (45) days from the date of death.

 

3.3. Force Majeure Invoked by the Passenger


If a Passenger holds a Ticket as described in 3.1(d), which is partially or fully unused due to Force Majeure (as defined in Article 1), the Carrier shall provide a credit voucher corresponding to the Fare Including Taxes (or Fare Excluding Taxes if taxes are refunded separately) for the non-refundable/non-changeable Ticket, valid for one year. The voucher must be used on a subsequent Carrier flight, provided the Passenger informs the Carrier as soon as possible and provides proof of the Force Majeure event.

 

3.4. Order of Use of Flight Coupons


Rules herein may vary depending on the Passenger’s residence, origin, and destination. Passengers must consult “Special Conditions” on the TACV – CABO VERDE AIRLINES website applicable to their residence, forming part of the General Conditions of Carriage.


(a) The Fare Including Taxes, based on flight dates and routes on the Ticket, corresponds to departure and destination via an Intermediate Stop when purchased, forming an integral part of the Transport Contract. The fare at Ticket issuance is only valid for Tickets used sequentially and completely in the order of Flight Coupons for the reserved journey and specified dates.
(b) Except in cases of Force Majeure, any misuse by the Passenger (e.g., failing to use the first Coupon or not following the issued order) entails payment of change fees and any fare differences at check-in for the next Coupon, at the Carrier’s Customer Service, Authorized Agency, or airport.

 

3.5. Changes requested by the Passenger are subject to fare conditions associated with the Ticket and applicable Service Fees.

 

3.6. Carrier Identification


The Carrier may be identified by an abbreviation on the Ticket corresponding to its Identification Code (Article 1). The Carrier’s address is considered the registered office or main operational establishment.

4.1. Fares


Unless otherwise indicated, Ticket Fares apply only to transport from the departure airport to the destination airport. Surface transport between airports or city terminals is not included. Fares are calculated according to rates in effect at Reservation for scheduled travel on the indicated dates and itinerary. Any change to the itinerary or travel date may affect the applicable fare. Passengers are informed of the Fare Including Taxes, Ticket Issuance Costs, and total fare (including taxes, carrier surcharges, and issuance costs) at Reservation.

 

4.2. Taxes, Fees, and Charges


Passengers must pay any taxes, fees, or charges imposed by governments, authorities, or airport operators. At Ticket Reservation, Passengers are informed of taxes, fees, or charges in addition to the Fare Excluding Taxes, itemized on the Ticket. Subsequent changes by governments, authorities, or airport operators may result in additional amounts payable by the Passenger or refunds in case of reduction or elimination (Article 14). If a Passenger waives a reserved flight, they are entitled to a refund of taxes, airport fees, and other charges tied to actual boarding, per applicable regulations.

 

4.3. Ticket Issuance Fees


The Carrier may charge issuance fees, varying by trip type, fare, and distribution channel. Fees are added to the Fare Including Taxes and are non-refundable, except in case of Carrier error. Passengers are informed of fees prior to completing the Reservation. Fees charged by TACV – Cabo Verde Airlines are available on its services and website.

 

4.4. Optional Services


The Carrier offers optional services such as preferred seat, extra legroom, additional baggage allowance, pet transport, special equipment, unaccompanied minor service, etc.


(a) Charges for optional services are separate from the airfare and not included in the ticket price.


(b) Depending on fare type, some services may be included, e.g., free seat assignment, checked baggage, ticket changes or cancellation.

 

4.4. Payment Currency


Fares Excluding Taxes, Taxes, Issuance Fees, and Service Fees are payable in the currency of the country of Ticket purchase, unless the Carrier or Authorized Agent specifies otherwise. At its discretion, the Carrier may accept payment in another currency.

 

4.5. Manifestly Incorrect Price / Fare Error


The Carrier draws the Passenger’s attention to possible fare errors affecting the Reservation price. Under applicable law, the Carrier may cancel any Reservation in case of presentation or technical error resulting in a manifestly incorrect or absurd price.

5.1. General Provisions
Reservations are only confirmed after recording in the Carrier’s reservation system. Upon Passenger request, the Carrier provides confirmation.

5.2. Reservation Requirements
Certain Fares may limit or exclude changes or cancellations. If the Ticket is not paid before the issuance deadline, the Reservation may be canceled, and the seat assigned to another Passenger, without Carrier liability.

5.3. Contact Details
The Passenger must provide a mobile number or email for contact at Reservation or, at latest, check-in. For reservations via an Authorized Agent, such information is communicated to the Carrier by the Agent. Failure to provide may limit access to information in case of irregularities.

5.4. Seat Assignment
The Carrier will attempt to accommodate seat requests but cannot guarantee a specific seat, even if reserved. The Carrier reserves the right to change seat assignments at any time, including post-boarding, for operational, security, protection, or Force Majeure reasons.

5.5. Onboard Services
The Carrier will attempt to accommodate Passenger requests regarding onboard services (drinks, special meals, movies, etc.). However, the Carrier is not liable if operational or safety imperatives prevent such services, even if confirmed at Reservation.

5.6. Aircraft Type
The type indicated at Reservation or later is for informational purposes only. Safety, security, and operational reasons may require changes without Carrier liability.

All Passenger personal data is collected and processed by TACV – CABO VERDE AIRLINES in accordance with TACV’s privacy policy.

7.1. The transportation of unaccompanied children, Passengers with Reduced Mobility, persons with illnesses, or any other persons requiring special assistance may be subject to special arrangements. Passengers are advised to inform the Carrier of their disability or any special assistance needs when making a Reservation. If the special assistance request is made after the Reservation or, according to applicable regulations, less than 48 hours before departure, the Carrier will, naturally, do its utmost to fulfill the request in accordance with applicable regulations, taking into account, in particular, the timing and specifics of the requested assistance. Special arrangements for the transport of persons as mentioned in this clause 7.1 are available, upon request, from the Carrier, its Authorized Agents, and on the TACV-CABO VERDE AIRLINES website.

 

7.2. If a Passenger requires a special meal, they must confirm its availability when making a Reservation (or when modifying a Reservation) or within the period communicated by the Carrier. Otherwise, the Carrier cannot guarantee the availability of the special meal on the flight concerned.

 

7.3. If a Passenger has a medical history or a specific clinical condition, it is their responsibility to consult a physician before travelling, particularly on a long-haul flight, and to take all necessary precautions to ensure the flight proceeds without incident.

8.1. Check-in deadlines vary by airport. Passengers must strictly comply with Check-in Deadlines to facilitate their journey and avoid cancellation of their Reservations. The Carrier or its Authorized Agent will provide the Passenger with all necessary information regarding the Check-in Deadline for the first flight on their itinerary.

 

8.2. Passengers must arrive in advance of the flight to complete all required travel formalities and, in all cases, must comply with the Check-in Deadline. If the Passenger fails to do so or does not present all documents required for check-in, thereby preventing travel, the Carrier may cancel the Passenger’s Reservation without any liability to the Passenger.

 

8.3. The Passenger must be present at the boarding gate before the boarding time indicated at check-in. The Carrier may cancel the Passenger’s Reservation if they are not present at the boarding gate by the indicated boarding time, without any liability to the Passenger.

 

8.4. Under no circumstances shall the Carrier be liable, in particular for any loss, damage, or expense, if the Passenger fails to comply with the conditions of this Article.

At any time during boarding and/or connection, the Carrier may refuse to transport the Passenger and their Baggage if any of the following circumstances occur or are likely to occur:


(a) The Passenger has not complied with applicable regulations.


(b) Transporting the Passenger and/or their Baggage may endanger the safety, health, welfare, or order on board the aircraft, particularly if the Passenger behaves in an intimidating, abusive, or insulting manner towards other Passengers or the crew.


(c) The Passenger’s physical or mental condition, including any condition resulting from alcohol, drugs, or medication, may present a danger or risk to themselves, other Passengers, crew, or property.


(d) In particular, the Passenger has threatened the interests of the Carrier or its personnel or has compromised or attempted to compromise their safety or that of other Passengers, particularly when booking tickets, checking in, boarding, or during a previous flight. In such cases, the Carrier may cancel any unused portion of the ticket and, subject to applicable regulations, refund the fare paid or only the relevant fees.


(e) In accordance with clause 15.8, the Carrier has notified the Passenger in writing of their inclusion on the list of persons prohibited from boarding the Carrier’s aircraft for future travel anywhere in the network. In this case, the unused Ticket will be refunded in accordance with Article 14 below, even if the Ticket is non-refundable.


(f) The Passenger cannot prove they are the person named in the “Passenger Surname” box on the Ticket.


(g) The Passenger (or the person who paid for the Ticket) has not paid the applicable Fare with Taxes, Issuance Fees, and/or applicable Charges.


(h) The Passenger does not appear to be in possession of valid travel documents, has attempted illegal entry into a country during transit, has destroyed travel documents during the flight, refused permission for copies to be made for Carrier use, or their travel documents are expired, incomplete, or appear fraudulent (identity theft, forgery, or counterfeiting).


(i) The Ticket presented by the Passenger:


  • was illegally acquired or purchased from a source other than the Carrier or its Authorized Agent, or
    • was reported lost or stolen, or
    • has been falsified or counterfeited, or
    • has a Flight Coupon that has been damaged or altered by someone other than the Carrier or its Authorized Agent.


(j) The Passenger refuses to pay a fare supplement and/or Service Fees under the conditions mentioned in clause 3.4.


(k) The Passenger refuses to pay a fare supplement under the conditions referred to in Article 10.


(l) The Passenger has not complied with safety instructions and regulations.


(m) A Passenger benefiting from a discounted fare or a fare subject to special conditions cannot provide the necessary proof for that fare and refuses to pay the fare adjustment set out in clause 3.1(i).

10.1. General Provisions


10.1.1 Passenger Obligations


(a) The Passenger declares full awareness of the contents of each of their Baggage.


(b) The Passenger undertakes not to leave their Baggage unattended from the time of packing and not to accept items from other Passengers or anyone else.


(c) The Passenger undertakes not to travel with Baggage delivered by third parties.


(d) The Passenger is advised to ensure their Baggage is properly and securely packed in suitable containers to avoid damaging its contents, other Passengers’ Baggage, or the Carrier’s aircraft.

 

10.1.2 Prohibited Items


The Passenger must not include in their Baggage any items whose transport is prohibited or restricted by applicable regulations and laws of any State of departure, destination, transit, or overflight, including, in particular:


(a) Items likely to endanger the aircraft, persons, or property on board, such as those specified in the ICAO (International Civil Aviation Organization) and IATA (International Air Transport Association) Dangerous Goods Regulations and the Carrier’s regulations, as applicable (further information available upon request); including, but not limited to, explosives, pressurized gases, oxidizers, radioactive, magnetized, flammable, toxic, corrosive, or liquid substances (except liquids in carry-on for personal use during travel).


(b) Items unsuitable for transport due to weight, size, configuration, or nature, considering the aircraft type. Information on such items is available upon request.


(c) Firearms and ammunition, except those intended for hunting or sport, which must be unloaded, properly packed, and have the safety catch engaged to be accepted as Checked Baggage. Ammunition transport is subject to ICAO and IATA Dangerous Goods Regulations.


(d) Cutting or piercing weapons, aerosols usable as weapons, collectible weapons, swords, knives, and similar items. These cannot be carried in the cabin under any circumstances but may be included in Checked Baggage with the Carrier’s prior explicit acceptance.


(e) Live animals, except pets, subject to conditions in clause 10.4.

 

10.1.3 Right of Inspection


For security reasons or upon authority request, Passenger Baggage may be inspected (X-ray or other technique). If the Passenger is unavailable, Baggage may be inspected in their absence to verify compliance with clause 10.1.2. Refusal may result in refusal of transport.

 

10.1.4 Right to Refuse Baggage


(a) The Carrier may refuse to transport or continue transporting Baggage containing prohibited items or if Passenger obligations under clauses 10.1.1(a)-(c) are not met. The Carrier is not obliged to take custody of refused Baggage.


(b) The Carrier may refuse items incompatible with air transport due to size, shape, weight, content, or nature.


(c) The Carrier may refuse Baggage for which the Passenger has refused to pay the surcharge in clause 10.2.2.


(d) The Carrier will not accept animals without required documents per clause 10.4.


(e) The Carrier may refuse Baggage not delivered before the Check-in Deadline under clause 10.2.1(a).

 

10.2 Checked Baggage


10.2.1 General Provisions


(a) Passenger must deliver Baggage at the Carrier’s check-in counter before the Check-in Deadline.


(b) Upon delivery, the Carrier assumes custody and issues a Baggage Receipt.


(c) Passenger must place contact details on Checked Baggage.


(d) Checked Baggage will, as far as possible, travel on the same flight as the Passenger unless operational or safety reasons dictate otherwise.


(e) Checked Baggage must be properly packed to protect contents.


(f) Fragile, perishable, or valuable items (cash, jewelry, art, electronics, passports, keys, etc.) should not be included.


(g) Medicines should not be included, subject to applicable regulations.


(h) Early termination of the journey may require a €400 fee to recover Checked Baggage.

 

10.2.2 Baggage Allowance


(a) Allowance corresponds to the number, weight, and dimensions specified per Passenger per fare.


(b) Excess Baggage requires a surcharge.


(c) Maximum weight per Passenger applies.


(d) All details are available from the Carrier or Authorized Agents.

 

10.2.3 Special Declaration of Interest


(a) Passengers may insure Baggage exceeding liability limits or declare Special Interest for a surcharge.


(b) Carrier may verify the declared value.


(c) Declarations must be made before Check-in Deadline.


(d) Further information available from the Carrier.

 

10.2.4 Collection and Delivery


(a) Passenger must collect Checked Baggage upon availability; unclaimed Baggage after 3 months may be disposed of by the Carrier.


(b) Only the bearer of the Baggage Receipt may collect Baggage.


(c) Proof of ownership required if receipt is lost.


(d) Acceptance of Baggage without complaint is prima facie evidence of delivery in good condition.

 

 10.3 Carry-on Baggage


(a) Tickets allow limited carry-on Baggage; placement must fit under the seat or in compartments. Excess may incur surcharge.


(b) Carry-on Baggage not complying with rules must be checked.


(c) Passenger is responsible for carry-on; Carrier liability limited under Article 19.

 

10.4 Pets


10.4.1 General Provisions


(a) Pet transport requires prior explicit acceptance.


(b) Limits apply per flight and per Passenger.


(c) Certain pets may be prohibited; information available on request.


(d) Valid documents required (passports, veterinary certificates, vaccinations,

permits).


(e) Conditions may apply by destination (age, weight, health check).


(f) Pets not included in Baggage Allowance; surcharge applies.


(g) Assistance dogs for reduced mobility Passengers transported free of charge.


(h) Carrier not liable for injuries, loss, delays, or death due to invalid or missing documents, except in cases of gross negligence.


(i) Further information on pet transport and surcharges available from the Carrier.

 

10.4.2 Cabin Pets


(a) Only pets within Carrier’s weight limit accepted. Assistance dogs per regulations.


(b) Pet must remain in a closed carrier allowing standing, turning, and breathing.
(c) Pet must not be removed from carrier during flight.

 

10.4.3 Hold Pets


Pets must be in rigid plastic or fiberglass IATA-approved carriers.

11.1 Flight schedules in Timetables are for information only; they are not contractual and may change.


11.2 The schedule indicated on the Ticket, subject to changes outside Carrier control, is part of the Transport Contract.


11.3 Passenger must provide contact details for schedule updates.

12.1 Carrier will take measures to avoid delays; alternative transport may be proposed.


12.2 For cancellations or delays with a single Contract of Carriage, applicable regulations apply.


12.3 Compensation claims under EC Regulation 261/2004 by third parties processed only after Passenger files claim directly.


12.4 Passenger may consult lawyers or third parties before submitting claim.
12.5 Rights to compensation, damages, or refund may not be assigned to third parties.


12.6 Compensation will be paid via bank transfer.

13.1 If overbooking prevents seat allocation, the Passenger will be compensated per applicable regulation.


13.2 Downgrade to lower class will result in refund per applicable regulation.

14.1 Refunds will follow fare conditions and applicable regulations.


14.2 Refunds based on Fare with Taxes paid.
14.3 Requests submitted to issuer (Carrier or Authorized Agent).


14.4 Carrier may refuse refunds if:


(a) Request made after validity period;
(b) Ticket required by law to leave country unless proof of alternative departure;
(c) Entry denied by authorities;
(d) Stolen, falsified, or counterfeit;
(e) Transport refused under Article 9, except clause 9(e).


14.5 Refunds subject to regulations of purchase and refund country.


14.6 US DOT 14 CFR § 259.5(b)(4): 24-hour risk-free cancellation for flights booked at least 7 days in advance.


14.7 Brazil ANAC No. 400/2016: 24-hour cancellation with full refund if booked at least 7 days before flight; refund within 7 days of cancellation request.

15.1 Passenger must not endanger, threaten, or disturb others, property, or aircraft.


15.2 Carrier may restrict electronics use.


15.3 Smoking prohibited.


15.4 Personal alcohol consumption prohibited.


15.5 Recording or broadcasting images/voice of crew or passengers prohibited without consent.


15.6 Non-compliance may result in disembarkation or restraint.


15.7 Carrier may pursue legal action for offences on board.


15.8 Non-compliance may result in inclusion on prohibited boarding list.

16.1 Carrier’s surface transport (limousine, bus, train, boat, etc.) subject to separate liability rules.


16.2 Carrier not liable for damage to Passengers or Baggage during land, rail, or maritime transport.

17.1 Multiple Carriers under a single or joint Ticket constitute one transport if intended as a single operation.


17.2 Carrier responsible only for transport performed by its own means.


17.3 Claims for loss, damage, or delay may be made against the Carrier performing the flight or the first and last Carriers.

18.1. General Provisions


(a) The Passenger must, and it is their responsibility to, obtain all specific and necessary documents, visas, and authorizations for the journey and, if applicable, for the travel of their minor children, Passengers for whom they are responsible, and/or Pets traveling with them. The Passenger must also comply with the applicable regulations of the States (of departure, destination, and transit) and with the Carrier’s instructions.


(b) The Carrier shall not be liable for any consequences suffered by the Passenger in case of failure to comply with the obligations referred to in point 18.1(a).

 

18.2. Travel Documents


(a) The Passenger must present all entry, exit, and transit documents, as well as health documents and any other documents required by the regulations in force in the States of departure, destination, and transit. In addition, the Passenger must provide such documents to the Carrier and/or allow the Carrier to make copies of them if necessary, or to record the information contained therein.


(b) In accordance with Article 9, the Carrier reserves the right to refuse carriage if the Passenger does not comply with the applicable regulations or if the Carrier has doubts regarding the validity of the presented documents.


(c) The Carrier shall not be liable for any consequences (in particular, losses or expenses) incurred by the Passenger for failing to comply with the applicable regulations.

 

18.3. Refusal of Entry


If entry into a territory is refused to a Passenger, they must pay all costs and fines imposed on the Carrier by local authorities, as well as the Fare including Taxes for the transport to be carried out if the Carrier, in compliance with a government order, is required to transport the Passenger back to their place of departure or another location. The Carrier will not refund the Ticket purchased for transport to the destination where entry was refused.

 

18.4. Passenger Liability for Fines, Detention Costs, etc.


If the Carrier must pay or deposit a fine or penalty, or advance any expenses due to the Passenger’s voluntary or involuntary non-compliance with the law in force in the relevant States, due to failure to present required documents, or due to presenting non-compliant documents, the Passenger shall, upon the Carrier’s request, reimburse the amounts thus paid or deposited, as well as incurred expenses. For this purpose, the Carrier may use any amounts already paid for unperformed transport or any amounts belonging to the Passenger that are held by the Carrier.

 

18.5. Customs Inspections


(a) The Passenger may be required to attend the inspection of their Baggage (delayed, Checked, or Cabin) at the request of customs officers or any other government authority. The Carrier shall not be liable for any Damage or loss suffered by the Passenger who fails to comply with this provision, particularly if the Passenger refuses to attend the inspection of their Baggage.


(b) The Passenger must indemnify the Carrier if any action, omission, or negligence on their part causes Damage to the Carrier, particularly due to non-compliance with the provisions of this Article or with the authorization given by the Carrier to carry out the inspection of their Baggage.

 

Security Checks


(a) The Passenger must submit to security checks required by government or airport authorities, as well as those required by the Carrier.


(b) The Carrier shall not be liable for refusing to transport a Passenger, particularly if such refusal complies with the law, regulations, and/or applicable requirements.

19.1. General Provisions


The Carrier’s liability shall be determined by the Carrier’s General Conditions of Carriage, unless otherwise communicated to the Passenger. If the Carrier’s liability is involved, the following applies:

 

19.1.1. Carriage performed under these General Conditions of Carriage is subject to the liability rules provided in the Montreal Convention of 28 May 1999 and Regulation (EC) No 889/2002 of the European Parliament and of the Council of 13 May 2002, amending Council Regulation (EC) No 2027/97 of 9 October 1997, concerning the liability of air carriers in the carriage of Passengers and their Baggage.

 

19.1.2. The Carrier is liable for damage in the event of death or bodily injury provided that the accident causing death or bodily injury occurred on board the aircraft or during any embarkation or disembarkation operations, under Article 17 of the Convention.

 

19.1.3. Provided that the following provisions do not contradict other provisions of these General Conditions of Carriage and subject to whether the Convention applies or not:


(a) The Carrier is only liable for Damage occurring during Air Carriage for which its Identification Code appears on the Coupon or Ticket corresponding to the flight. If the Carrier issues a Ticket for a service performed by another Carrier or checks in Baggage on behalf of another Carrier, the first Carrier acts only as an agent of the latter. However, regarding Checked Baggage, the Passenger may make claims against both Carriers involved in their journey.


(b) The Carrier’s liability shall not exceed the amount of proven direct Damage, and the Carrier shall in no case be liable for indirect Damage or any other form of non-compensatory Damage.


(c) The Carrier shall not be liable for Damage resulting from compliance with any legal or regulatory provisions (laws, regulations, decisions, requirements, and provisions) or from the Passenger’s failure to comply with such provisions.


(d) The Carrier shall not be liable for Damage to Cabin Baggage unless such Damage was directly caused by the C

arrier or one of its partners or agents, as demonstrated by the Passenger.


(e) The Carrier is not responsible for any illness, injury, disability, or death of the Passenger caused by the Passenger’s physical condition or any worsening of such condition.


(f) The Transport Contract, including these General Conditions of Carriage and all exclusions and limitations of liability, shall apply to and benefit the Carrier’s Authorized Agents, partners, and agents acting on its behalf, the aircraft owner used by the Carrier, as well as the owner’s agents, employees, and representatives. The total recoverable amount from the above-mentioned persons shall not exceed the Carrier’s liability amount.


(g) If the Damage was caused or contributed to by the negligence, wrongful act, or omission of the claimant or the person from whom their rights derive, the Carrier shall be fully or partially exempt from liability toward that person, including in the case of death or bodily injury.


(h) Unless expressly stated otherwise, none of these provisions constitutes a waiver of any exclusion or limitation of liability of the Carrier, the aircraft owner, its agents, partners, or representatives, in accordance with the Convention and applicable law.

 

19.2. Provisions Applicable to International and Domestic Flights

19.2.1. Bodily Injury:


(a) In accordance with Article 17 paragraph 1 of the Montreal Convention of 28 May 1999, the Carrier is liable for damage resulting from death or bodily injury a Passenger may suffer if the accident causing the Damage occurred on board the aircraft or during any embarkation or disembarkation operations, subject to exclusions of liability.


(b) The Carrier shall not be liable if it proves that:

  • Death or bodily injury resulted from the Passenger’s physical or mental condition before boarding.
  • The Damage referred to above was caused, wholly or partially, by the negligence, wrongful act, or omission of the claimant or the person from whom their rights derive, under Article 20 of the Montreal Convention.
  • The Damage was not caused by the Carrier or its partners/agents if the Damage exceeds 151,880 SDR per Passenger, according to Article 21 paragraph 2(a) of the Montreal Convention.
  • The Damage results solely from third-party acts, provided the Damage exceeds 151,880 SDR per Passenger, according to Article 21 paragraph 2(b).

(c) Compensable Amount:

  • The Carrier’s liability in case of death or bodily injury of a Passenger is not limited. Compensation shall cover proven Damage, agreed amicably, via expert assessment, or by competent courts.
  • The Carrier will only compensate the Passenger up to amounts received under their social security system and for compensatory damages.

(d) The Carrier reserves any rights of recourse or subrogation against third parties.

(e) In case of death or bodily injury resulting from an air accident under Article 17 of the Montreal Convention, and Article 5 of Regulation (EC) No 889/2002, the Beneficiary may receive an advance payment for immediate needs, proportional to material Damage, not less than 16,000 SDR in case of death. This advance shall be settled within 15 days and deducted from final compensation. Such payment does not constitute acknowledgment of liability and may be deducted from later payments.

19.2.2. Delay


(a) Characteristics of compensable Damage: only direct, proven, and directly caused Damage is compensable; indirect or non-compensatory Damage is excluded.
(b) Scope of Carrier’s liability: The Carrier shall not be liable if it proves that it or its partners/agents took all reasonable measures to prevent the Damage, or if it was impossible to take such measures. The Carrier is not liable for Damage caused by Passenger’s actions or omissions.


(c) Scope of compensation:

  • For Passenger Damage caused by delay (excluding intentional or reckless acts by the Carrier), liability is limited to 6,303 SDR per Passenger.
  • For delay in delivery of Checked Baggage, liability is limited to 1,519 SDR per Passenger; a lump-sum may cover essential expenses.

 

19.2.3. Baggage


(a) In accordance with Article 17 of the Montreal Convention, the Carrier is liable for Damage to Checked Baggage if the accident causing the Damage occurred on board or while in the Carrier’s custody.


(b) Exclusions: The Carrier is not liable for Damage resulting from the nature or inherent defect of Baggage. The Passenger must indemnify the Carrier if Baggage contents cause Damage. Liability for fragile, valuable, or improperly packed items is subject to special declaration and surcharge (point 10.2.3). The Carrier is not liable for Damage caused by the claimant or their rights-holder.


(c) Amount of compensable Damage:

  • Checked Baggage: liability is limited to 1,519 SDR per Passenger, unless a higher value was declared.
  • Cabin Baggage: liability exists only if irregularities by the Carrier or its agents/partners are proven, limited to 1,519 SDR per Passenger.

20.1. Baggage Claims Notification


(a) Receiving Checked Baggage without filing a claim within the deadlines constitutes prima facie evidence that the Baggage was delivered in good condition and in accordance with the Transport Contract. Any missing Baggage must be reported upon arrival; late reports are disregarded. Missing items must be reported as soon as possible.
(b) In case of delay, damage, or destruction, the Passenger must submit a written claim within seven (7) days (damage/destruction) or twenty-one (21) days (delay) from availability. Late claims are inadmissible, except in cases of Carrier fraud. If claims are timely but unresolved, legal action may be taken within two years from the flight’s arrival date.

 

20.2. Civil Liability Actions by Passengers


Any civil liability action must be filed within two years from arrival, scheduled arrival, or layover date. Calculation of deadlines follows the jurisdiction’s case law.

 

20.3. Claims and actions must be submitted in writing within the specified deadlines.
